APPELLATE BENCH
Appellate Bench performs following functions:

Perform all actions in connection with the affairs of the Appellate Bench stipulated in Securities and Exchange Commission of Pakistan (Appellate Bench Procedure) Rules, 2003 including:

  • Receiving all appeals, replies and other documents.
  • Deciding all questions arising out of the scrutiny of the appeals before they are registered.
  • Requiring any appeal presented to the Appellate Bench to be amended in accordance with the Appellate Bench Procedural Rules or any other relevant law.
  • Fixing the dates of hearing of appeals or other proceedings, and accordingly issue notices thereof.
  • Ordering the grant of copies of documents or proceedings to the parties.
  • Granting leave to inspect the record of the Appellate Bench.
  • Disposal of all matters relating to service of notices or other processes.
  • Requisitioning of records from the custody of any adjudicating authority.
  • Maintenance of the record of appeals received by the Appellate Bench.
Perform all functions assigned by the Appellate Bench, including:

  • Preparation of monthly/quarterly schedule for the Appellate Bench hearings and updating the list of hearings.
  • Preparation of the annual budget and annual report of Appellate Bench Registry.
  • Preparation of written brief of appeals filed.
  • Co-ordination with the concerned departments/division and the Appellants with regard to the upcoming hearings.
  • Calling for information from third parties on behalf of Appellate Bench.
  • Any other assignment entrusted by the Appellate Bench.
Performing functions ancillary to the above, including:

  • Administrative arrangements for all Appellate Bench hearings.
  • Briefing the Commissioners on appeals.
  • Case law research on the instruction of the Appellate Bench.
  • Reporting the cases to Corporate law digest (CLD) for publication.
  • Upgrading the Appellate Bench’s Order database.
